TERMS AND CONDITIONS

Welcome to GozoCabs.

These Terms and Conditions ("Terms") govern your access to and use of the websites, mobile applications, communication channels, customer-support systems and other technology platforms operated by Gozo Technologies Private Limited ("Gozo", "GozoCabs", "we", "us" or "our").

Gozo Technologies Private Limited has its office at F-210, UGF, Sushant Shopping Arcade, Sushant Lok Phase-I, Gurugram, Haryana – 122001, India.

Please read these Terms carefully.

By accessing or using the Gozo Platform, creating an account, making or confirming a booking, making a payment, travelling pursuant to a booking, or otherwise using Gozo's Services, you acknowledge that you have read, understood and agreed to be bound by these Terms, our Privacy Policy and the terms applicable to your specific booking.

If you make a booking on behalf of another person, you are responsible for informing that traveller of these Terms and relevant booking conditions. These Terms shall apply to the Customer as well as the Traveller, as applicable.

In these Terms, "including" means "including without limitation."

1. DEFINITIONS

Gozo / GozoCabs

"Gozo" or "GozoCabs" means Gozo Technologies Private Limited.

Gozo Platform / Platform

"Gozo Platform" means Gozo's websites, mobile applications, telephone and call-centre systems, SMS, WhatsApp and other messaging channels, customer and vendor management systems, support-ticketing systems, APIs, automated systems and other technology or communication channels through which Gozo facilitates its Services.

Customer / Consumer / You

"Customer", "Consumer" or "You" means any individual, company, organisation, agent or other person accessing or using the Gozo Platform or making a booking through Gozo.

Traveller

"Traveller" means the person or persons who actually use the Transportation Service. The Customer and Traveller may or may not be the same person.

Where the Customer makes a booking for another Traveller, the Customer is responsible for communicating these Terms and all relevant booking information to such Traveller.

Provider / Provider Partner / Operator

"Provider", "Provider Partner" or "Operator" means an independent third-party taxi operator, fleet operator, vehicle owner, transportation service provider or other person or entity using or interacting with the Gozo Platform to offer Transportation Services.

Driver

"Driver" means a person engaged, employed or otherwise authorised by a Provider to operate a vehicle used for fulfilling a booking.

Transportation Service

"Transportation Service" means the actual transportation service provided to the Customer or Traveller by a Provider.

Services

"Services" means the technology, marketplace, booking, communication, customer-support, payment-facilitation and related services provided or facilitated through the Gozo Platform.

Data Breach

“Data Breach” means unauthorised access, disclosure, alteration, loss, or destruction of Personal Data.

2. NATURE OF GOZO'S SERVICES

Gozo operates a technology-enabled marketplace/platform that facilitates discovery, booking, communication, coordination and payment between Customers seeking Transportation Services and independent third-party Providers offering such Transportation Services.

Unless expressly stated otherwise for a particular service:

Gozo does not itself provide the Transportation Service.

The actual Transportation Service is provided by an independent third-party Provider.

Gozo does not ordinarily own or operate the vehicles used to provide Transportation Services and does not employ the Drivers providing such Transportation Services.

Providers independently determine how they operate their transportation businesses, subject to applicable law, their contractual obligations with Gozo and applicable Gozo Platform policies.

Nothing contained in these Terms shall be construed as creating an employer-employee, partnership, joint venture, agency or principal-agent relationship between Gozo and any Provider or Driver.

Gozo's involvement in facilitating bookings, payments, communications, customer support, quality monitoring, technology services or operational coordination does not by itself make Gozo the provider or operator of the Transportation Service.

3. RESPONSIBILITIES OF PROVIDERS AND DRIVERS

The Provider is independently responsible for the Transportation Service provided to the Customer.

Providers are responsible for ensuring, as required by applicable law, that vehicles and Drivers used to fulfil bookings possess appropriate registrations, licences, permits, insurance, fitness certificates and other legally required documents or authorisations.

Providers are responsible for maintaining their vehicles in a roadworthy condition and for the conduct of their Drivers and other personnel.

Gozo may undertake reasonable verification, onboarding, quality-control and compliance measures in relation to Providers, Drivers and vehicles.

However, such measures do not constitute a guarantee or warranty by Gozo regarding the conduct, performance, safety, suitability or continued compliance of any Provider, Driver or vehicle.

4. BOOKINGS

Customers may request Transportation Services through the Gozo Platform.

All bookings are subject to availability of suitable Providers, Drivers and vehicles.

A booking shall generally become confirmed when Gozo issues a booking confirmation through the Platform, email, SMS, WhatsApp or another authorised communication channel.

Your booking confirmation may specify:

vehicle category;

  • pickup and destination details;
  • estimated fare;
  • payment requirements;
  • estimated distance and duration;
  • Free Cancellation Period;
  • cancellation charges;
  • fare inclusions and exclusions; and
  • other booking-specific conditions.

You are responsible for reviewing your booking confirmation and promptly informing Gozo if any material information is incorrect.

Where booking-specific terms conflict with these general Terms, the more specific booking terms shall apply to that booking to the extent of such inconsistency.

5. DRIVER AND VEHICLE DETAILS

Gozo may provide Driver and vehicle information after a Driver and vehicle have been allocated to your booking.

Customers are strongly advised to verify before commencing the journey that the Driver and vehicle reasonably correspond with the information communicated by Gozo.

Customers should verify, in particular, the vehicle registration number and Driver identity.

Where operational circumstances reasonably require substitution of a Driver or vehicle, the Provider may arrange a replacement subject to applicable law and Gozo's policies.

Where reasonably practicable, updated Driver or vehicle information will be communicated to the Customer.

If the Driver or vehicle is materially different from the information provided by Gozo and no updated information has been communicated, the Customer should contact Gozo before commencing the journey.

A Customer who voluntarily chooses to travel in an unauthorised vehicle or with an unauthorised Driver contrary to information provided by Gozo may assume additional risks associated with that decision.

6. SAFETY

Gozo takes Customer and Driver safety seriously.

Pickup and drop addresses must be valid and reasonably accessible residential, commercial or public locations.

A Driver may refuse to enter or wait at a location that reasonably presents a safety, accessibility or legal concern and may request the Customer to use an alternative nearby pickup or drop point.

Gozo, the Provider or Driver may require reasonable proof of identity from a Customer or Traveller for safety, fraud-prevention, booking verification or regulatory purposes.

Customers must not use the Platform or interact with a Driver in any manner that distracts the Driver or encourages violation of traffic or safety laws.

For long-distance journeys, Providers may implement Driver rest periods, Driver changes or vehicle changes where reasonably required for safety or regulatory reasons.

7. CUSTOMER CONDUCT AND RESPONSIBILITIES

Customers and Travellers must comply with applicable laws and behave appropriately towards Drivers, Providers, Gozo personnel and other persons.

Customers and Travellers shall not:

threaten, abuse, intimidate, harass or assault a Driver, Provider or Gozo representative;

  • intentionally or negligently damage a vehicle;
  • excessively soil a vehicle;
  • carry unlawful, dangerous, hazardous or prohibited goods;
  • request or encourage a Driver to violate traffic or other laws;
  • interfere with the safe operation of a vehicle;
  • exceed legally permitted passenger or luggage capacity;
  • use the Platform for fraudulent or unlawful purposes;
  • provide materially false booking or identity information;
  • misuse promotional offers, credits, referral programmes or Gozo Coins;
  • initiate fraudulent or improper payment disputes or chargebacks;
  • impersonate another person; or
  • misuse Driver,

Provider or Customer information obtained through the Gozo Platform.

A Driver or Provider may refuse to commence or may discontinue a Transportation Service where there is a reasonable safety, legal or behavioural concern.

Gozo may suspend or terminate access to the Platform in cases involving suspected fraud, misuse, abusive behaviour, safety concerns, non-payment or material violation of these Terms.

8. PRICING

Prices displayed on the Gozo Platform may change until a booking is confirmed.

Despite reasonable efforts, pricing or availability errors may occasionally occur.

Where an obvious pricing or system error occurs, Gozo may contact the Customer for approval of the corrected price or cancel the booking without applying cancellation charges attributable solely to that error.

Bookings created with assistance from Gozo's customer-support personnel may include a support-facility or assisted-booking charge.

Where such a charge has been clearly included in the booking price, it represents costs associated with providing assisted-booking facilities and may be non-refundable once the service has been provided.

9. FARE INCLUSIONS AND ADDITIONAL CHARGES

Depending upon the booking type, the quoted fare may include or exclude additional charges such as:

tolls;

  • parking charges;
  • state or interstate taxes;
  • permit charges;
  • airport charges;
  • Driver allowance;
  • night allowance;
  • waiting charges;
  • additional kilometres;
  • additional hours; and
  • applicable taxes.

The booking confirmation will specify the principal inclusions and exclusions applicable to your booking.

Where actual usage exceeds the booked distance, duration, itinerary or package limits, additional charges may become payable.

A change requested by the Customer to the destination, route, pickup point, travel date, travel time or itinerary may result in a change in fare.

10. PAYMENTS

Customers agree to pay all amounts legitimately due in connection with their booking.

Gozo may collect or facilitate collection of payments on behalf of Providers and may use third-party payment processors.

Customers authorise Gozo and applicable payment partners to process booking payments, refunds, adjustments and other legitimate booking-related transactions.

Amounts due may include:

booking fares;

  • cancellation charges;
  • waiting charges;
  • additional kilometre or hour charges;
  • tolls and parking;
  • taxes and permits;
  • damage or cleaning charges;
  • payment reversals or chargebacks; and
  • other legitimate charges

arising from the booking.

Gozo may suspend further use of the Platform until undisputed outstanding amounts are paid.

11. PROMOTIONS AND GOZO COINS

Gozo may offer promotional discounts, coupons, credits or Gozo Coins from time to time. Unless expressly stated otherwise, promotional offers cannot be combined.

Gozo Coins and promotional credits:

are intended for use on eligible future Gozo bookings;

  • have no cash value;
  • cannot ordinarily be transferred or exchanged for cash; and
  • are subject

to applicable promotional terms.

Gozo may cancel promotional credits obtained through fraud, misuse, system error or violation of promotional conditions.

12. CANCELLATION POLICY

Gozo aims to provide Customers flexibility in managing their travel plans.

A booking may generally be cancelled before the scheduled pickup time through the Gozo Platform or authorised customer-support channels.

Free Cancellation Period

Your booking confirmation will ordinarily specify a date and time until which your booking may be cancelled without cancellation charges.

This is your "Free Cancellation Period."

If you cancel before expiry of the Free Cancellation Period, no cancellation charge shall ordinarily apply unless your booking-specific terms expressly provide otherwise.

After expiry of the Free Cancellation Period, cancellation charges may apply.

The applicable cancellation charges and relevant time windows will be communicated as part of your booking terms.

Accessing Driver and Vehicle Information

Gozo attempts to provide Driver and vehicle details as soon as they become available.

For bookings where this condition is expressly communicated, accessing Driver or vehicle information may end your Free Cancellation Period.

Before you access such information, Gozo will endeavour to provide reasonable notice that accessing the information will end your Free Cancellation Period.

If you proceed after receiving such notice and subsequently cancel the booking, applicable cancellation charges may become payable.

Purpose of Cancellation Charges

Cancellation charges compensate Gozo and/or the Provider for costs incurred, vehicle allocation, Driver allocation and lost opportunities resulting from holding transportation capacity for your booking.

Assisted Bookings

Where your booking was created using chargeable assisted-booking or customer-support facilities, applicable support-facility charges may remain non-refundable following cancellation because those services have already been provided.

13. CUSTOMER NO-SHOW

A Customer is considered a "No-Show" where the Customer or Traveller is not present at the agreed pickup location and the assigned Driver is unable to establish reasonable contact with the Customer at the scheduled pickup time.

Unless the booking terms specify otherwise, the Driver may wait for approximately 30 minutes from the scheduled pickup time.

After the applicable waiting period, the booking may be treated as cancelled due to Customer No-Show.

The Customer may be liable for up to the entire Booking Amount as a cancellation/no-show charge where permitted by the applicable booking terms and law.

14. RESCHEDULING

Customers should inform Gozo as early as reasonably possible of any requested change to the scheduled departure time.

Gozo recommends providing at least 24 hours' notice where practicable.

A request for rescheduling does not guarantee that the same vehicle, Driver, Provider or price will remain available.

Rescheduled bookings may be subject to availability and revised pricing.

15. CANCELLATION BY GOZO OR PROVIDER

Gozo aims to achieve the highest possible booking fulfilment rate.

However, circumstances may occasionally prevent a Provider from fulfilling a confirmed booking.

Where Gozo or the Provider is unable to fulfil a confirmed booking, Gozo may attempt to arrange an alternative Provider or vehicle.

Where no reasonably suitable alternative is available and the booking cannot be fulfilled, amounts collected in advance for the unprovided Transportation Service will be refunded, subject to applicable law.

Gozo may additionally provide promotional credits or Gozo Coins as a goodwill gesture. Such goodwill credits are not cash compensation and are subject to applicable promotional terms.

16. REFUND POLICY

Where a Customer is entitled to a refund following cancellation or non-fulfilment, the refundable amount shall generally equal the amount paid in advance less applicable cancellation charges, non-refundable support-facility charges and other amounts legitimately due.

Approved refunds will ordinarily be initiated by Gozo within 20 working days.

After Gozo initiates the refund, additional time may be required for the amount to appear in the Customer's bank, card, wallet or payment account depending upon the relevant bank, card network, payment gateway or payment provider.

Refunds cannot ordinarily exceed the amount actually paid by the Customer for the relevant booking.

Where applicable, Customers should provide their Booking ID and payment information reasonably required to identify and process the refund.

17. JOURNEY TIMES, ROUTES AND DELAYS

All journey durations, pickup times, distances, routes and estimated arrival times displayed or communicated through Gozo are estimates only and are not guaranteed.

Actual travel may be affected by:

  • traffic;
  • weather;
  • road conditions;
  • road closures;
  • accidents;
  • demonstrations;
  • governmental restrictions;
  • natural events;
  • vehicle breakdowns;
  • Driver rest requirements; or
  • other circumstances outside Gozo's reasonable control.

Customers travelling for flights, trains, meetings, appointments or other time-sensitive events are responsible for allowing adequate additional travel time.

To the maximum extent, Gozo shall not be liable for consequential losses resulting from delays, including missed flights, trains, appointments, meetings, connections or events.

18. VEHICLE BREAKDOWN OR DISRUPTION

Vehicles may occasionally experience mechanical or operational problems despite reasonable maintenance.

Where a vehicle becomes unable to continue a journey, the Provider and/or Gozo may make reasonable efforts to arrange repairs, a replacement vehicle or another practical solution.

The availability and timing of a replacement cannot be guaranteed, particularly in remote locations or during circumstances outside reasonable control.

19. LOST PROPERTY

Customers and Travellers are responsible for their personal belongings during Transportation Services.

Gozo does not take custody of passenger belongings and does not guarantee recovery of property left in a vehicle.

Where reasonably possible, Gozo may assist the Customer in communicating with the relevant Provider or Driver regarding lost property.

Gozo shall not be responsible for loss, theft, damage, destruction or non-recovery of personal belongings except where liability cannot lawfully be excluded.

20. DAMAGE OR EXCESSIVE CLEANING

Customers may be responsible for reasonable cleaning, repair or restoration costs resulting from intentional or negligent damage or excessive soiling of a vehicle caused by the Customer, Traveller or persons travelling as part of the Customer's booking.

Gozo may facilitate recovery of such charges on behalf of the Provider after considering reasonable supporting information.

21. ELECTRONIC COMMUNICATIONS

By using the Gozo Platform, you consent to receiving booking-related and administrative communications electronically through channels including:

  • email;
  • SMS;
  • WhatsApp;
  • telephone;
  • mobile notifications; and
  • in-platform communications.

Electronic communications may constitute written communications.

Transactional communications necessary to administer or fulfil a booking may be sent irrespective of marketing preferences.

Marketing communications will be subject to applicable law and available opt-out mechanisms.

22. AUTOMATED AND AI-ASSISTED SERVICES

Gozo may use automated systems, artificial intelligence, chatbots and similar technologies for purposes including:

  • booking assistance;
  • customer support;
  • communication;
  • fraud prevention;
  • operational support; and
  • service improvement.

Automated or AI-generated responses are intended to assist Customers but may occasionally contain incomplete, inaccurate or outdated information.

Where information provided by an automated or AI-assisted system conflicts with a confirmed booking, invoice, fare, cancellation policy or other formal booking record, the applicable formal booking record shall prevail, subject to applicable law.

Customers should contact Gozo customer support where an automated response appears materially inconsistent with their confirmed booking.

23. YOUR GOZO ACCOUNT

You may require a Gozo Account to access certain Services.

Accounts may include individual, agent, reseller or corporate accounts.

You are responsible for maintaining the confidentiality of your account credentials and for activities occurring through your account.

You should promptly notify Gozo if you reasonably suspect unauthorised access to your account. Gozo may suspend, restrict or terminate an account where reasonably necessary because of:

  • suspected fraud;
  • misuse;
  • safety concerns;
  • unlawful activity;
  • repeated non-payment;
  • abusive conduct; or
  • material violation of these Terms.

24. AGE REQUIREMENTS

A person must ordinarily be at least 18 years old to independently create and operate a Gozo Account.

A person under 18 should not independently book or receive Transportation Services unless accompanied or appropriately authorised and supervised by a responsible adult, subject to applicable law and Provider policies.

25. LIMITATION OF LIABILITY

To the maximum extent, Gozo shall not be liable for indirect, incidental, special, exemplary, punitive or consequential loss or damage arising from use of the Gozo Platform or Transportation Services.

This includes, without limitation, loss arising from:

  • missed flights or trains;
  • missed appointments, meetings or events;
  • loss of business opportunity;
  • loss of profits;
  • loss of anticipated savings; or
  • consequential travel arrangements.

Where Gozo is legally liable in connection with a particular booking, Gozo's aggregate liability shall, to the maximum extent, be limited to the lower of:

(a) the amount actually paid by the Customer to Gozo in respect of the relevant booking; or

(b) ₹10,000.

Where Gozo is legally liable in connection with a single event, incident, systemic service failure, or Data Breach (as defined in Clause 26A) affecting multiple bookings or Customers simultaneously, Gozo's total aggregate liability to all affected Customers collectively arising from that event shall not exceed ₹1,00,000 in any 12-month period. Where claims arising from such an event exceed this aggregate limit, individual Customer claims shall be reduced pro rata.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

26. PRIVACY AND PERSONAL DATA

Gozo processes personal data in accordance with its Privacy Policy.

Information reasonably necessary to fulfil and support a booking may be shared with Providers, Drivers, payment processors, customer-support providers, technology providers and other service providers involved in delivering the Services.

Gozo may obtain and process information including booking information, transaction information, communications, device information and location-related information for purposes including:

  • booking fulfilment;
  • customer support;
  • safety;
  • fraud prevention;
  • payment processing;
  • legal and regulatory compliance; and
  • improvement of Gozo's Services.

Customers should review Gozo's Privacy Policy for further information regarding processing of personal data.

26A – DATA BREACH NOTIFICATION AND LIABILITY

26A.1

Scope. This clause applies to personal data collected from you, including your name, contact details (email/phone used for login), location, payment information, and travel details shared while booking a ride.

26A.2

Notification to Users. In the event of a Data Breach affecting your Personal Data, we will notify you without undue delay, in accordance with the Digital Personal Data Protection Act, 2023, through the email address or phone number registered with your account, along with the nature of the Breach and steps being taken.

26A.3

Our Responsibility. We shall implement reasonable security safeguards to protect your Personal Data and shall be liable for losses limited to the general limitation of liability as defined above in this Agreement.

26A.4

Your Cooperation. You agree to promptly notify us if you suspect unauthorised access to your account (e.g., compromised login credentials) to help us prevent or mitigate any Breach.

27. INTELLECTUAL PROPERTY

The Gozo Platform and its software, trademarks, logos, designs, text, graphics and proprietary materials belong to Gozo or their respective licensors.

Use of the Services does not grant Customers ownership of Gozo intellectual property.

Customers may not copy, reproduce, reverse engineer, commercially exploit, remove legal notices from or otherwise misuse Gozo's intellectual property except as expressly authorised or permitted by applicable law.

28. THIRD-PARTY TRANSPORTATION SERVICES

Customers acknowledge that Transportation Services booked through the Platform are ordinarily provided by independent third-party Providers.

Accordingly, to the maximum extent, Gozo shall not be responsible for acts or omissions attributable solely to a Provider or Driver, including matters relating to:

  • Driver conduct;
  • driving;
  • vehicle condition;
  • route selection;
  • Provider delays;
  • vehicle breakdown;
  • accidents;
  • statutory compliance by the Provider;
  • loss or damage attributable to the Provider;
  • or
  • other failures.

in performance of the Transportation Service by the Provider.

Nothing in these Terms excludes or restricts liability of Gozo that cannot lawfully be excluded or restricted.

29. WARRANTIES AND DISCLAIMER

Gozo provides its Platform and Services using commercially reasonable efforts. However, the Platform and Services are provided on an "as available" basis.

Gozo does not guarantee:

  • uninterrupted availability of the Platform;
  • availability of a particular Provider;
  • availability of a particular vehicle or Driver;
  • completion within an estimated journey time;
  • uninterrupted telecommunications or internet connectivity; or
  • that Platform information will always be error-free.

To the maximum extent, warranties not expressly provided in these Terms are excluded.

Nothing in these Terms limits statutory rights available to Customers that cannot lawfully be waived.

30. CUSTOMER INDEMNITY

To the extent, the Customer agrees to indemnify and hold harmless Gozo, its affiliates, directors, officers, employees and representatives against third-party claims, liabilities, losses, damages, penalties, costs and reasonable expenses arising directly from:

the Customer's material breach of these Terms;

  • fraudulent or unlawful

use of the Platform;

  • intentional or negligent damage

caused by the Customer or Traveller to a Provider, Driver, vehicle or third party;

violation of applicable law or third-party rights by the Customer or Traveller; or

  • materially false information supplied by the Customer.

This indemnity shall not apply to the extent that the relevant claim results from Gozo's own breach of applicable law or contractual obligations.

31. FORCE MAJEURE

Gozo shall not be responsible for failure or delay caused by circumstances beyond its reasonable control. Such circumstances may include:

fire, flood, earthquake, storm or other natural disaster;

  • epidemic or pandemic;
  • war, hostilities, sanctions or embargoes;
  • terrorism or threats

of terrorism;

  • rebellion, civil disturbance, demonstrations or riots;
  • strikes, lockouts

or labour disruption;

  • governmental or regulatory action;
  • fuel shortages;
  • disruption of transportation infrastructure;
  • telecommunications, internet or technology failures;
  • road closures; and
  • other comparable circumstances outside Gozo's reasonable control.

During such circumstances, Services may be suspended, delayed, modified or subject to revised pricing where reasonably necessary.

Gozo will endeavour, where reasonably practicable, to communicate material disruptions affecting confirmed bookings.

32. CUSTOMER COMPLAINTS AND GRIEVANCES

Customers should report complaints concerning Transportation Services as soon as reasonably practicable and preferably within 7 days after completion of the relevant trip.

Prompt reporting helps Gozo obtain relevant information from the Provider and investigate the complaint effectively.

Complaints submitted substantially later may be more difficult to investigate because relevant records or evidence may no longer be readily available.

Nothing in this provision restricts statutory rights or legally prescribed complaint periods available to Customers.

Customers may contact Gozo through the customer-support and grievance channels published on the Gozo Platform.

33. SUSPENSION OR TERMINATION OF SERVICES

Gozo may suspend, restrict or terminate access to all or part of the Platform where reasonably necessary because of:

fraud or suspected fraud;

  • unlawful activity;
  • abusive or threatening conduct;
  • safety concerns;
  • repeated non-payment;
  • misuse of promotions or Gozo Coins;
  • misuse of the Platform; or
  • material violation of these Terms.

Termination or suspension does not extinguish amounts or obligations accrued before termination.

Customers may stop using the Gozo Platform at any time.

34. CHANGES TO SERVICES

Gozo continuously develops and improves its Services.

Gozo may add, modify, replace, suspend or discontinue features or Services where reasonably necessary.

Where reasonably practicable and appropriate, Gozo will provide notice of material changes affecting existing Customers or confirmed bookings.

35. CHANGES TO THESE TERMS

Gozo may modify these Terms from time to time to reflect changes in its Services, business practices, technology or applicable law.

The latest version will be published on the Gozo Platform with an updated "Last Updated" date.

Changes will apply prospectively unless immediate application is reasonably necessary for legal, regulatory, security or operational reasons.

Where required by applicable law, material changes will be separately notified or consent obtained.

Continued use of the Platform after revised Terms become effective constitutes acceptance of the revised Terms.

36. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by the laws of India.

The Customer and Gozo should first attempt in good faith to resolve disputes through Gozo's customer grievance mechanism.

Any dispute may, at the Customer's option, be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended. Nothing in this clause requires a Customer to submit to arbitration, and a Customer retains the unqualified right to instead approach a consumer forum or commission of competent jurisdiction under the Consumer Protection Act, 2019.

Where a Customer elects arbitration, it shall be conducted by a sole independent arbitrator mutually agreed upon by the parties. Where the parties are unable to agree upon an arbitrator, appointment shall be made in accordance with applicable law. The language of arbitration shall be English. The seat and venue of arbitration shall be Gurugram, Haryana, unless otherwise mutually agreed.

Subject to the Customer's right under Section 34(2) of the Consumer Protection Act, 2019 to file a complaint before the consumer commission having jurisdiction over the Customer's place of residence or work, courts at Gurugram, Haryana shall have jurisdiction in relation to matters arising from these Terms that are not resolved through arbitration or before a consumer forum.

Nothing in this clause prevents a Customer from exercising any right or remedy available under applicable consumer-protection law.

37. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be severed or interpreted to the minimum extent necessary while the remaining provisions shall continue in effect.

38. NO WAIVER

Failure by Gozo to enforce any provision of these Terms on any occasion does not constitute a waiver of Gozo's right to enforce that provision subsequently.

39. ENTIRE AGREEMENT AND BOOKING-SPECIFIC TERMS

These Terms, together with:

Gozo's Privacy Policy;

  • your booking confirmation;
  • applicable fare terms;
  • cancellation conditions;
  • promotional terms; and
  • service-specific terms communicated in connection with your booking, constitute the terms governing your use of the relevant service.

Gozo Services.

Where a booking-specific or service-specific term directly conflicts with these general Terms, the more specific term shall prevail for that booking or service.

By accessing or using the Gozo Platform, creating or confirming a booking, making payment, or otherwise using Gozo's Services, you confirm that you have read, understood and agreed to these Terms and Conditions and the applicable terms of your booking.
